Overview
تتطلب عقود الاستثمار فترة زمنية طويلة قد تتغير خلالها الظروف الاقتصادية والاجتماعية، حيث تحتوي هذه العقود على شروط تسمح بتكييف العقد وفقا لاقتصاد التنمية، ويتطلب تنفيذها مجموعة من المؤهلات الخاصة. لهذا، فإن أطراف عقد الاستثمار على استعداد دائما لإدراج بند تسوية منازعات الاستثمار، والذي يتكون من الموافقة على تسوية نزاعاتهم من خلال التحكيم، كضمان عملي لتشجيع الاستثمار. وقد أولت التشريعات الوطنية والدولية اهتماما واسعا باتفاق التحكيم القائم على مبدأ سيادة الإرادة، ومنح الحرية لإرادة الأطراف عند إبرام اتفاقيات الاستثمار والعقود لاختيار النظام القانوني المناسب لتسوية النزاعات التي قد تنشأ بينهما لاحقا.
