Overview
إن المشرع المغربي عند تنظيمه لمؤسسة حق الانتفاع لم يوليها الأهمية اللازمة فيما يخص الآثار القانونية المترتبة على حقوق الأغيار عند انقضاء حق الانتفاع بموت المنتفع، حيث أن العديد من الإشكالات القانونية يكتنفها الغموض بسبب الفراغ التشريعي. كما أن تقديم حق الانتفاع كضمان عيني أو الاستثمار فيه عن طريق الكراء لفائدة الغير قليل جدا في الممارسة العملية، إذ قلما نجد حق انتفاع مثقل برهن جبري أو حجز من طرف الدائن العادي، وذلك راجع بالأساس إلى ضعف الضمانات القانونية التي يمنحها الحق المترتب على حق الانتفاع باعتباره حق عيني مؤقت مهدد بالزوال.
