Overview
رغم أن مبدأ الفصل بين السلطات لا يزال ركيزة المجتمعات الديمقراطية إلا أن العمل به يتم وفق نظرة واقعية في إطار تكاملي بين السلطات الدستورية فالتعديلات التي طرأت على الوثيقة الدستورية بما في ذلك التعديل الأخير للدستور في نوفمبر 2020 تكرس ما يعرف بالفصل المرن، وهو جوهر خفي لنظرية الفصل بين السلطات، وبدون ذلك فإن استقلالية السلطات تصبح عائقا لممارسة السلطة.
