Overview
تعتبر المحافظة على كيان المجتمع، وحمايته من انتشار الجريمة من أهم مقاصد الشريعة الإسلامية. وقد أصل الفقهاء المصالح التي تحميها قواعد التجريم، وبناء على ذلك، كانت الأفعال التي تهدر إحدى هذه المصالح جديرة بالتجريم، بحيث يكون من شأن التجريم كفالة الحماية الكاملة لهذه المصالح. ويهدف هذا البحث إلى بيان علة الجنائية في الحدود، وقد بدأته بتمهيد عرفت فيها كلا من (العلة، الجناية، الجريمة، والحد)، وذكرت أن الحدود منها ما هو حق خالص الله، ومنها ما يجتمع فيها حق العبد مع حق الله، ومن ثم شرعت ببيان العلة الجنائية لكل حد من هذه الحدود، كل على حدة. وقد خلص البحث إلى أن العلة الجنائية في الحدود تدور في فلك جلب مصالح العباد ودرء المفاسد عنهم، والتي تتجلى في حفظ الضروريات الخمس.
