Overview
لا تقتصر آثار القرار الإداري على أطرافه الأساسية المتمثلة بمصدر القرار والمخاطبين به، بل تمتد لتشمل الغير الأجنبي عن هذه العلاقة القانونية، والذي يملك طرقاً قانونيةً تسمح له بالتدخل فيها، بحيث يمكن أن يؤدي هذا التدخل إلى تدمير القرار بإلغائه قضائياً. وهذا الغير إما أن يوجد بالقرب من هذه العلاقة القانونية بحيث يتدخل وقت إنشائها أو أثناء تنفيذها أو يبقى بعيداً عنها، ومع ذلك يجب عليه الاعتراف بها واحترام وجودها بل وتحمل آثارها التي قد تضر بمصالحه، فيتدخل وقتها من خلال الطعن بها قضائياً، وهو ما سنتناوله في بحثنا هذا من خلال التطرّق إلى كيفية تحديد هذا الغير، وعلاقته بالأطراف الأساسية للقرار الإداري، وبحث دوافعه للتدخل بالطعن بالإلغاء بهذا القرار.
