Overview
الإجماع هو المصدر الثالث من مصادر التشريع، وحجة شرعية يجب العمل به على كل مسلم، ودليل من أدلة الفقه المتفق عليها، وهذا الدليل مستنده الكتاب؛ لأن الأصل هو الكتاب، ثم السنة؛ لأنها مخبرة عن حكم الله، ثم الإجماع. وقد تعددت آراء علماء الأصول في قبول الإجماع السكوتي أو رفضه، أو اعتباره إجماعا ظنيا، وذلك لضعفه، ولشبهة حمل السكوت على معنى الموافقة، فإذا ثبت هذا بشروطه فلا يضره الضعف.
