Overview
ان الوجود القانوني للوقف لا يتحقق الا بتحقق الاوصاف القانونية التي تطلبهـا قـانون الوقف في اركانه الاربعة تحت طائلة البطلان، وهي اوصاف او شـروط تناسـب فـي ضرورتها وفي شدتها المقتضيات والآثار التي يرتبها هذا التصرف، كما انها تنسجم مع البعد الشرعي التعبدي للوقف، واخيرا هي ترسم شكل الإطار النظامي لهـذا التـصرف الوقفي الذي يصدق ان يقال عنه انه نظام تعتبر الشريعة الاسـلامية المـصدر المـادي لقواعده.
