Overview
الأصل في المرهون أن يكون مقسوماً غير شائع، إلا أنه في بعض الأحيان يكون المرهون مشاعاً بين اثنين، أو أكثر في عقار، أو منقول، ويكون أحد الشركاء بحاجة إلى رهن حصته بغية الحصول على المال دفعاً لحاجته. وبما أن المشاع حالة واقعة في المنقول وغير المنقول؛ فقد تناول البحث دراسة مسألة رهن المشاع، من حيث بيان مفهومه، وأنواعه، وأسباب الخلاف بين الفقهاء، وآراء الفقهاء في حكم رهنه، وأدلتهم، ومناقشتها، والراجح في ذلك، وموقف القانون المدني الأردني من حكمه.
