Overview
يهدف هذا البحث إلى تناول المعنى الدقيق للقبض كما حدده القانون وبيان حدوده وحصر الحالات المبررة لتفتيش الشخص وسيارته، كما يهدف إلى بيان حالة التلبس التي يعول عليها القانون وبيان بطلان الدليل المستمد من الإجراء الباطل. ولقد خلص البحث إلى عدم جواز وبطلان القبض على قائد المركبة المشتبه في تناوله الخمر ما دام قد امتنع عن توقيع الكشف الطبي عليه.
