Overview
عرفت أصول الفقه في عصرنا قراءات عديدة، غرضها تناول فلسفة التشريع من منظور معاصر، انصبت على إعادة بناء مقاصد الشريعة وفق حاجات العالم الإسلامي المعاصر، بعضها اجتمع فيه المنهج العلمي بالمنهج الفلسفي بالمناهج التراثية، وأهم قراءة معاصرة كانت لحسن حنفي في كتابه (من النص إلى الواقع)، غرضها تحويل علم أصول الفقه إلى علم سلوكي يعطي الأولوية للواقع على النص، لكن تبني قراءة منطق الفقه للمناهج المعاصرة جعلها تتعرض للكثير من الانتقادات.
