لقد أمرت الشريعة بالاجتهاد؛ لما له من مكانة سامية، والاجتهاد قد يكون فرديا، وقد يكون جماعيا، وهذا البحث يتناول قضية هامة خاصة في هذا العصر، ألا وهي: \"الاجتهاد الفقهي الجماعي عند الأستاذ الدكتور عمر سليمان الأشقر\". فيقوم البحث بالكشف عن مفهوم الاجتهاد الجماعي، ومشروعيته، وأهميته، ومدى حاجتنا إليه، وخاصة في ظل النوازل الفقهية، والمستجدات المعاصرة، ثم يوضح البحث بالتفصيل موقف الأستاذ الدكتور عمر الأشقر من الاجتهاد الفقهي الجماعي، ومدى اهتمامه به في فتاويه، وكتبه؛ ليبين طرفا من جهوده العظيمة فيما يتعلق بالجانب الفقهي.
