Overview
نظرا لأن الأملاك العقارية تحتاج دائما إلى مصاريف متعددة، سواء تعلق الأمر بصيانتها أو إصلاحها وترميمها، فقد دعت الحاجة إلى العمل على استثمار هذه الأملاك لتحقيق أغراضها المستهدفة، وتنمية ريعها والحفاظ على ديمومة الانتفاع بها. ركزت الدراسة على صيغة الإيجار كآلية لاستثمار الوقف، وبالتحديد الإيجار الوقفي الفلاحي، حيث يعتبر عقد إيجار الأملاك الوقفية من أكثر الطرق استعمالا في تثمير الأوقاف ونظرا لخصوصية الوقف باعتباره نظاما قائما بذاته، فإنه يخضع لأحكام خاصة. ونظم المشرع الجزائري الإيجار الوقفي الفلاحي بأحكام تنظيمية خاصة للوقوف عندها يمكن توضح هذا الأخير.
