Overview
إن الدولة القانونية تقوم على مبدأ المشروعية الذي يعتبر الالتزام به أساسا لحماية حقوق الأفراد وحرياتهم من تعسف السلطات الإدارية، غير أن هذا المبدأ يحتاج إلى شيء من المرونة ،تأخذ بعين من الاعتبار رسالة الإدارة العامة ومهامها التي تتلخص في تحقيق الصالح العام في القواعد القانونية الشرعية، ويترتب على ذلك إعطاء الإدارة قدرا من حرية التصرف طبقا لاحتياجات العمل ومتطلباته وطبيعة العمل نفسه، والظروف المتغيرة من حيث الزمان والمكان للموازنة في هذا الأمر نجد :السلطة التقديرية، الظروف الاستثنائية وأعمال السيادة .
