يتناول هذا البحث دراسة للقاعدة الفقهية: \"الجواز الشرعي ينافي الضمان\"، وتطبيقاتها في الفقه الإسلامي والقانون، وذلك من حيث بيان معناها، وتأصيلها الشرعي، ومفهومها في القانون، وعرض تطبيقاتها في الفقه الإسلامي والقانون ومستثنياتها. ويخلص البحث إلى أن القاعدة الفقهية: \"الجواز الشرعي ينافي، الضمان لا يعمل بمقتضاها وفق شروط معينة في الفقه الإسلامي والقانون، وذلك فيما إذا استعمل المكلف حقه على الوجه المأذون فيه شرعا، وهذا مجال إعمال القاعدة من غير تعسف أو مجاوزة في فعل غير مشروع.
