Overview
إقامة العدل بمفهومه الموضوعي والشمولي يعتبر أهم مقاصد الشريعة الإسلامية، فالعدل مأمور به شرعا في تعامل الفرد مع الفرد أو الجماعة، وتعامل سلطة الحكم مع المحكومية .وهذا كله يحتاج إلى قواعد عامة ومجردة واجبة التطبيق يرضخ لها الكافة حكاما ومحكومين. ومن هنا تأتي الرقابة القضائية على شرعية ما يصدر عن سلطات الحكم وأدواته لاتصافها بالموضوعية والجرأة. وهذا ما جسده قضاء المظالم الذي يعتبر قمة الرقابة في الدولة الإسلامية لما امتاز به من تجسيد للعدل وقمع للظلم سواء أتى من الحكام أو المحكومين، وهذا ما سنفصله في هذا البحث.
