Overview
حق الابتكار المسمى بحق الملكية الفكرية في العصر الحاضر حق معتبر في الشريعة الإسلامية، ويعالج هذا البحث موضوع الحق المالي للمبتكر في الفقه الإسلامي في حالة جزئية خاصة وهي حالة تزاحم هذا الحق المالي مع حق الأمة وحق الباحث وصاحب الحاجة في تلبية احتياجاته. وهذه الدراسة بينت منهج الشريعة في التوفيق بين الحقوق بالجمع بينها وإعطاء كل ذي حق حقه ومنع التعدي، وإلا فالموازية بين الحقوق عند تزاحمها بتقديم خير الخيرين أو دفع شر الشرين، وتقديم ما ليس له بدل على ما له بدل، ومنع احتكار العلم والاستغلال السيئ له، وتقديم الضرورة أو الحاجة العامة مع حفظ حق العالم أو المبتكر.
