من صفوة القول، إن سمو مبدأ المشروعية يجعل الإدارة شأنها شأن باقي الأفراد خاضعة لسيادة القانون. وملزمة بتنفيذ الأحكام القضائية الصادرة ضدها. نظرا للقوة الإلزامية التي تفرضها الأحكام القضائية الحائرة علي قوة الشيء المقضي به. الصادرة ضد لإدارة. والتزام الإدارة بتنفيذ هذه الأحكام ليس ضعفا من جانبها وإنما تجسيدا لسيادة القانون ومساواة الجميع أمامه. كونها هي الأولى باحترام القانون والالتزام بحدوده. لأنه بدون تنفيذ. تصير الأحكام القضائية عديمة الفعالية. وتهدد الأمن ولاستقرار الاجتماعي وتعدم ثقة المواطنين في العدالة.
