تعتبر الأملاك الوقفية في الأصل، أملاكا خاصة، تحولت بالإرادة الحرة لملاكها الواقفين إلى نظام مستقل بذاته، يرمي إلى تحقيق غاية نبيلة، تتمثل في تسبيل منفعة ذلك الملك، والتصدق به على وجوه البر والخير.nلذلك يجب استيعاب الطبيعة الخاصة للوقف، واستقلاليته التامة عن الملكية الخاصة للإفراد، وكذلك عن الملكية العامة للدولة، فهو نظام قائم بذاته يتمتع بالشخصية المعنوية ويعترف به القانون ويحميه.
