Overview
اختلفت الوسائل الخاصة بمعالجة النزاعات العقدية فتارة يتم اللجوء للقضاء وتارة أخرى يتم إلى إجراءات التسوية التوافقية ألا أن أنجع هذه الوسائل هو التحكيم، وقد أخذت الأنظمة الحديثة بالتحكيم كوسيلة لحل المنازعات لما صار اليه من نجاح في ديمومة المشاريع وعدم توقفها بسبب صفته التوافقية وقد جاءت تعليمات تنفيذ العقود الحكومية رقم 2 لسنة 2014 مؤكدة على اللجوء للتحكيم كأحد الطرق البديلة لفض المنازعات التعاقدية دون اللجوء للقضاء.
