كرس المشرع الجزائري بموجب القانون 16-09 المتعلق بترقية الاستثمار حرية انجاز الاستثمارات، بشرط مراعاة النشاطات المقننة التي يحكمها نظام قانوني خاص، ومن بينها القطاع المصرفي الذي تخضع عملية الاستثمار فيه للأمر 03-11 المتعلق بالنقد والقرض، المعدل والمتمم.nلذا يهدف هذا المقال إلى إبراز القيود القانونية المفروضة على عملية الاستثمار في القطاع المصرفي سواء أثناء مرحلة الإنجاز - تأسيس البنوك والمؤسسات المالية- او في مرحلتي الاستغلال والتصفية.
