Overview
Negotiation is one of the oldest and most famous friendly and peaceful methods used in the settlement of conflicts, particularly of which are the constructional disputes. There is no question of course about the importance of using negotiating in the first place to settle down disputes, especially in the international constructional contracts due to the complex technical nature of these contracts which might not be easy to understand by the non-parties, a thing which in the end will maintain good relations between them. Building on analyzing the definition, characteristics and elements of negotiation, this research will offer recommendations considering encouraging the partners to resort to negotiations before going to judicial or arbitration due to what distinguishes this means of plenty of benefits that spares resorting to the courts.
