يدور هذا البحث حول أثر الاجتهاد المقاصدي على تطبيق النص الشرعي، حيث يبين مفهوم الاجتهاد المقاصدي في تطبيق النص الشرعي وأهميته ومشروعيته والأسس التي يقوم عليها، مع ذكر جملة من الأمثلة التطبيقية على أثر الاجتهاد المقاصدي على تطبيق النص الشرعي، ويبين اتجاهات الفقهاء في المقصد الواجب مراعاته عند تطبيق النص الشرعي، وقد خلص البحث إلى أنه لابد من تفهم هذا النص الشعري في ضوء حكمة التشريع، ومقصده، وغايته، ولابد من تطبيق المنصوص عليه في الواقع على الوجه الذي يحقق تلك الغاية.
