Overview
سلطت هذه الدراسة الضوء على حكم ضمان الرهن في يد المرتهن، وبينت أقوال الفقهاء، وأدلتهم فيها؛ للوصول إلى الراجح منها، وبيان ما عليه العمل في القانون المدني الأردني، وقد خلصت الدراسة إلى ترجيح الرأي القائل بأن يد المرتهن على الرهن يد أمانة لا ضمان عليها إلا في حال التعدي والتقصير، وأما إن كان التلف بغير ذلك فلا ضمان على المرتهن، كما لا ينقص ذلك من حقه شيئاً.
