يهدف هذا البحث إلى الإحاطة بمختلف الجوانب المتعلقة بآلية من آليات الترقية العقارية، والتي تبانها المشرع الجزائري مجدداً مع تحينها بما يتماشى ومتطلبات سوق الترقية العقارية، وهي آلية \"العقد التمهيدي لحفظ الحق\".nكخلاصة، يمكن أن نستنج أن هذه الآلية تم اعتمادها كأداة لخدمة المرقي العقاري؛ حيث أنها تتيح له التأكد من مدى جدوى المشروع العقاري المزمع تجسيده، وبنفس المناسبة تسمح بتحديد عناصر الصفقة من خدمات وسعر.nعلاوة على ما تقدم، فإن إبرام عقود حفظ الحق يجعل المؤسسات المالية في طمأنينة فيما يخص فرص نجاح العملية التي من أجلها يلتمس المرقي العقاري قروضها.
