تتلخص هذه الدراسة في تسليط الضوء على ماهية بطاقة الائتمان الإلكتروني وعلى أحكام المسؤولية المدنية الناشئة عن استخدامها. فتبين لنا أن المسؤولية المدنية للاستعمال غير المشروع لبطاقة الائتمان قد تثبت بحق أي من أطراف العقد إذا أخل أحدهم بالتزاماته العقدية، حيث تقوم المسؤولية المدنية هنا على أساس تعاقدي، أما في حالة ضياع البطاقة أو سرقتها ووقوعها في يد الغير فتنعقد المسؤولية على أساس تقصيري. لذلك فمن أجل تحقيق أهداف هذا البحث فقد قام الباحثان بالاعتماد على المنهج الوصفي الذي يقوم بوصف الطبيعة القانونية لبطاقات الائتمان.
