فإن القاعدة الفقهية القضائية: ''اليمين على أقوى المتداعيين شبهة'' من أهم القواعد القضائية في مرحلة تعيين الطرف الذي يقع عليه عبء الإثبات حيث إنها من الأصول المطردة في طرائق الإثبات المنوطة بالقضاء، وقد استدل بها الفقهاء وعللوا بها الأحكام، كما أن هذه القاعدة وثيقة الصلة بمقاصد الشريعة لأن في القضاء بالحق إظهار للعدل ورفع للظلم وإنصاف للمظلوم وإيصال الحق إلى أهله، وعلى هذا يجب مراعاة هذا المقصد عند النظر في طرق الإثبات وتفسيرها وتنفيذها فكانت الحاجة ماسة إلى دراستها دراسة تأصيلية وتطبيقية تشرح مفرداتها، وتوثيقها، وبيان ألفاظها، وتأصيلها الشرعي، وصلتها بقواعد الشريعة ومقاصدها وبيان أشهر تطبيقاتها وفروعها.
