La maîtrise des mers a connu un processus séculaire de régulation, encore en évolution, et qui peut éclairer sur le management des nouveaux espaces en exploration ou en création comme le cyberespace. Espace de guerre, de commerce et de piraterie, la mer fut le champ où s’établissent le partage du monde et la constitution des empires, dans un jeu de relations entre États et compagnies de commerce. De voie de communication qui aurait pu se satisfaire d’un principe de liberté de la mer, cet espace a vite été reconnu pour ses ressources, de la pêche jusqu’au pétrole et autres minerais, ressources rares et disputées. Les pollutions marines ont aussi mis en évidence le besoin de protection de l’environnement marin tandis que les migrations massives par mer mettaient à l’épreuve le droit international de la mer et les relations entre États et organisations internationales. L’exercice de la souveraineté sur la mer repose sur des moyens nationaux dans le cadre de politiques maritimes plus ou moins intégrées au niveau national et européen et souvent décalées par rapport aux enjeux. L’espace maritime fait l’objet de zonages complexes établis sous l’égide des Nations Unies. Mais le principe n’a pas changé depuis la portée de canon. Un État ne peut revendiquer une souveraineté en mer que sur des espaces où il démontre sa capacité à assurer l’ordre, la sécurité et la protection des hommes et des ressources. The mastery of the seas has undergone a centuries-old process of regulation, still evolving, and which can shed light on the management of new spaces in exploration or creation such as cyberspace. A space of war, trade and piracy, the sea was the field where the division of the world and the formation of empires were established, in a game of relations between states and trading companies. From a means of communication that could have been satisfied with a principle of freedom of the sea, this space was quickly recognized for its resources, from fishing to oil and other minerals, scarce and disputed resources. Marine pollution also highlighted the need to protect the marine environment, while mass migration by sea tested international law of the sea and relations between states and international organisations. The exercise of sovereignty over the sea is based on national means within the framework of maritime policies that are more or less integrated at national and European level and often out of step with the issues. The maritime area is subject to complex zoning set set set set set set sets under the aegis of the United Nations. But the principle has not changed since the gun range. A state can claim sovereignty at sea only in areas where it demonstrates its capacity to ensure order, security and the protection of people and resources.
