Overview

This article analyzes the historical construction of motherhood and the concept of maternal love, as well as the romanticization of motherhood in art and media discourse, reflecting on its implications in the field of law and women's rights. From the interface between law and literature, Aline Bei's work O peso do pássaro morto (The Weight of the Dead Bird) is examined for its contribution to breaking the idealized image of motherhood. The study investigates how the romanticization of motherhood, reproducedin literature and art, influences the social understanding of what it means to be a mother and affects the way the state treats motherhood. This is a bibliographic study, developed based on historical and deductive methods. It concludes that the idealization of motherhood and the standards socially imposed on women, perpetuated by art and the media, go beyond the symbolic plane and reach the legal sphere, restricting women's autonomy and negatively impacting the exercise of their sexual and reproductive rights.Objective:The objective of this study is to analyze the romanticization of motherhood in art and the media, especially in literature, investigating its impact on the social understanding of what it means to be a mother and on women's rights, based on the interface between law and literature.Theoretical Framework:The theoretical framework is based on the historical and social construction of motherhood, on the notion of “maternal love” as a cultural product rather than a natural instinct, and on a critical analysis of the romanticization of motherhood in art, the media, and law. Noteworthy are the studies by Philippe Ariès on the history of childhood and the family, Maria de Jesus Correia on motherhood as a socio-historical experience, Elisabeth Badinter (cited indirectly), and Fabiana de Souza Halasi on the construction of the maternal ideal and guilt-ridden motherhood. In the field of the interface between law and literature, the work dialogues with productions that highlight how artistic and media narratives influence legal discourses and state practices, especially with regard to women's rights, compulsory motherhood, and sexual and reproductive rights.Method:The methodology adopted consists of bibliographic research, based on academic works, scientific articles, legislation, and literary productions. Historical and deductive methods were used, starting from an analysis of the historical construction of the concept of motherhood and maternal love, and then examining the romanticization of motherhood in art, the media, and its reflections in law. The work O peso do pássaro morto(The Weight of the Dead Bird), by Aline Bei, is analyzed as a central object of reflection for breaking with the idealized view of motherhood, allowing for an interdisciplinary approach between law and literature.Results and Discussion:The results show that motherhood, as socially conceived, is the result of historical and cultural constructs that have naturalized the ideal of maternal love as inherent to the female condition. The romanticization of motherhood, widely reproduced by art and the media, sets unattainable standards for women, generating frustration, psychological distress, and feelings of guilt, as well as negatively impacting those who do not wish to become mothers. An analysis of the work O peso do pássaro morto(The Weightof the Dead Bird) reveals the rupture of this ideal by portraying motherhood marked by sexual violence, absence of maternal love, and emotional ambivalence, contrasting with hegemonic discourses. In the discussion, these results are contextualized in light of the theoretical framework, demonstrating how these discourses reach the legal field, influencing the limitation of female autonomy and unequal treatment between women and men with regard to reproduction, abortion, and parental responsibility.Research Implications:The theoretical and practical implications of this research focus on the fields of law, literature, gender studies, and public policy. The study contributes to the problematization of compulsory motherhood and to critical reflection on the discourses that support the restriction of women's sexual and reproductive rights. The analyses may influence academic debates, legal practices, and artistic and media productions, encouraging more realistic and humane representations of motherhood and promoting greater autonomy for women over their bodies.Originality/Value:This study contributes to the literature by articulating, in an interdisciplinary manner, Law and Literature in the critical analysis of the romanticization of motherhood, using the work The Weight of the Dead Bird as an instrument to break with idealized discourses. Its originality lies in its approach, which highlights how artistic narratives and discourses reflect legal values and state practices related to motherhood. The value of the research lies in its ability to broaden the debateon women's rights, question the naturalization of maternal love, and propose a reframing of motherhood from more pluralistic, realistic perspectives committed to female dignity and autonomy Objetivo: O objetivo deste estudo é analisar a romantização da maternidade na Arte e na mídia, especialmente na Literatura, investigando seus impactos na compreensão social do que é ser mãe e nos direitos das mulheres, a partir da interface entre Direito e Literatura. Referencial Teórico: O referencial teórico fundamenta-se na construção histórica e social da maternidade, na noção de “amor materno” enquanto produto cultural e não instinto natural, e na análise crítica da romantização da maternidade na Arte, na mídia e no Direito. Destacam-se os estudos de Philippe Ariès sobre a história da infância e da família, Maria de Jesus Correia acerca da maternidade como vivência sócio-histórica, Elisabeth Badinter e Fabiana de Souza Halasi quanto à construção do ideal materno e da maternidade da culpa. No campo da interface entre Direito e Literatura, o trabalho dialoga com produções que evidenciam como narrativas artísticas e midiáticas influenciam discursos jurídicos e práticas estatais, especialmente no tocante aos direitos das mulhereseà maternidade compulsória. Método: A metodologia adotada consiste em pesquisa bibliográfica, com base em obras acadêmicas, artigos científicos, legislação e produções literárias. Foram utilizados os métodos histórico e dedutivo, partindo-se da análise da construção histórica do conceito de maternidade e do amor materno para, posteriormente, examinar a romantização da maternidade na Arte, na mídia e seus reflexos no Direito. A obra O peso do pássaro morto, de Aline Bei, é analisada como objeto central de reflexão por romper com a visão idealizada da maternidade, permitindo uma abordagem interdisciplinar entre Direito e Literatura. Resultados e Discussão: Os resultados evidenciam que a maternidade, tal como concebida socialmente, é fruto de construções históricas e culturais que naturalizaram o ideal do amor materno como inerente à condição feminina. A romantização da maternidade, amplamente reproduzida pela Arte e pela mídia, estabelece padrões inalcançáveis para as mulheres, gerando frustrações, sofrimento psíquico e sentimentos de culpa, além de impactar negativamente aquelas que não desejam exercer a maternidade. A análise da obra O peso do pássaro mortorevela a ruptura desse ideal ao retratar uma maternidade marcada por violência sexual, ausência de amor materno e ambivalência emocional, contrastando com os discursos hegemônicos. Na discussão, tais resultados são contextualizados à luz do referencial teórico, demonstrando como esses discursos alcançam o campo jurídico, influenciando a limitação da autonomia feminina e o tratamento desigual entre mulheres e homens no que se refere à reprodução, ao aborto e à responsabilização parental. Implicações da Pesquisa: As implicações teóricas e práticas desta pesquisa concentram-se nos campos do Direito, da Literatura, dos estudos de gênero e das políticas públicas. O estudo contribui para a problematização da maternidade compulsória e para a reflexão crítica sobre os discursos que sustentam a restrição dos direitos sexuais e reprodutivos das mulheres. As análises podem influenciar debates acadêmicos, práticas jurídicas e produções artísticas e midiáticas, incentivandorepresentações mais realistas e humanas da maternidade e promovendo maior autonomia das mulheres sobre seus corpos. Originalidade/Valor: Este estudo contribui para a literatura ao articular, de forma interdisciplinar, Direito e Literatura na análise crítica da romantização da maternidade, utilizando a obra O peso do pássaro morto como instrumento de ruptura dos discursos idealizados. A originalidade reside na abordagem que evidencia como narrativas artísticas e discursos refletem valores jurídicos e práticas estatais relacionadas à maternidade. O valor da pesquisa está na sua capacidade de ampliar o debate sobre os direitos das mulheres, questionar a naturalização do amor materno e propor a ressignificação da maternidade a partir de perspectivas mais plurais, realistas e comprometidas com a dignidade e autonomia feminina.
