Overview
El presente trabajo tiene por objeto el análisis del alcance y las consecuencias que implica la regulación que introduce el art. 10 del Reglamento 2019/1111 a los efectos de la concentración jurisdiccional del pleito, en los casos que la acción de responsabilidad parental se presente vinculada a un proceso de divorcio. Estos supuestos, que encuentran respuesta expresa en el art. 12 del Reglamento 2201/2003, no son objeto de específica consideración en el nuevo precepto. La estructura del art. 10, relativo a la «elección del órgano jurisdiccional» como indica su rúbrica, deriva de la unificación de los dos casos que distingue el art. 12 al que modifica, referidos, respectivamente, a aquel en el que la acción sobre responsabilidad parental estuviera vinculada a un litigio matrimonial (art. 12.1), y al que dicha acción se presente de forma independiente (art. 12.3). Junto a la estructura, otro motivo esencial que justifica el objeto que se aborda, deriva de la consideración del contenido del art. 10, por cuanto su reglamentación se articula sobre la base de la ofrecida por el art. 12.3 y, por tanto, prevista para el segundo de los casos señalados.
The purpose of this work is to analyze the scope and consequences of the regulation introduced by art. 10 of Regulation 2019/1111 for the purposes procedure the concentration of jurisdiction in the cases in which an action in parental responsibility is connected to a divorce process. These assumptions, which find an express response in art. 12 of Regulation 2201/2003, are not subject to specific consideration in the new precept. The structure of art. 10, related to the «election of the court» as indicated by its heading, derives from the unification of the two cases distinguished by art. 12 (which is modified), respectively, the one in which the action on parental responsibility was linked to a matrimonial litigation (art. 12.1), and to which this action is presented independently (art. 12.3). Along with the structure, another essential reason that justifies the object being addressed, derives from the consideration of the content of art. 10, as its regulation is articulated on the basis of the one offered by art. 12.3 and, therefore, for the second of the cases indicated.
