Overview
Los tribunales internacionales han recurrido al principio de buena administración de justicia para justificar determinadas decisiones que, o bien no encuentran una base jurídica expresa en la normativa estatutaria o reglamentaria aplicable, o bien suponen una flexibilización en su aplicación, lo que se traduce en el ejercicio de unos poderes que se consideran inherentes a la función judicial. Este principio, cuyo contenido es impreciso, tiene dos funciones principales: velar por el buen desarrollo del procedimiento y garantizar la justicia de la decisión. En este trabajo estudiamos algunas manifestaciones de este principio a la hora de aplicar e interpretar la cláusula de revisión y la aportación de prueba adicional en apelacion a traves de la practica de los tribunales penales internacionales ad hoc, en particular, en el Tribunal Penal Internacional para la Antigua Yugoslavia, el Tribunal Penal Internacional para Ruanda y el actual Mecanismo Residual Internacional de los Tribunales Penales. Una practica que puede ser muy util en la litigacion internacional, no solo ante la Corte Penal Internacional, sino tambien ante otros tribunales internacionales. International courts and tribunals refer to the principle of good administration of justice to justify certain decisions that do not find a legal basis expressly provided neither in their statutes nor in their rules of procedure or when they interpret the procedural rules in a flexible manner. In those cases, they exercise inherent powers necessary to ensure the fulfilment of their judicial function. This principle, whose content is imprecise, has two main purposes: to safeguard the proper administration of proceedings and to guarantee the justice of the decision. In this paper we study several manifestations of this principle in the application and interpretation of the procedural provisions of revision and additional evidence in appeal. We focus on the judicial practice of the International Criminal Tribunal for the former Yugoslavia, the International Criminal Tribunal for Rwanda, and the International Residual Mechanism for Criminal Tribunals. These precedents can be extremely useful when litigating in the International Criminal Court as well as in other international courts.
