Overview
THE MEASURE would stiffen penalties for giving false information on a FOID card application and for transferring three or more firearms to a person who did not properly display a valid FOID card. The legislation also would require defendants, as a condition of bond, to physically surrender their FOID card to the clerk of the circuit court when charged with certain violent offenses. Those convicted of any felony offense would be required to physically surrender any and all firearms in their possession, and to also physically surrender their FOID cards as a condition of remaining on bond, pending sentencing. Other Senate bills introduced this year proposed to: increase fees for FOID card applications; require applications be submitted in person; require FOID card applicants to complete a firearms safety course; allow law enforcement search and seizure of firearms from certain court defendants. These bills failed to make it to the floor after constitutional questions were raised in committee hearings.
