If you don't name a guardian, and you and your spouse should die, \"There may be unnecessary tension and expense as family members members compete to be the child's guardian,\" [Steven Rothman] said. \"Some person you may deem an inappropriate guardian may be appointed by the court or may win an unpleasant legal battle to become the child's guardian.\" He added, \"It's a good idea to discuss it with a potential guardian. What's the point of naming somebody who's not going to accept? A lot of people name a guardian - or an executor or trustee - and never say anything to them.\" Some people name the same person as guardian and trustee; others choose two different people to ensure the guardian is spending money on the child and not on himself, [C. Boyd Cote] said.
