Judge Joseph S. Conte denied the group's request Thursday, saying that the time was \"not ripe\" for an injunction, William I. Strasser, Montvale Cares' attorney, said Thursday. \"It was the judge's position that it was not ripe for the stay,\" Strasser said. \"It was basically premature.\" Conte reversed the zoning board's decision on Dec. 8, saying that the planned use was inherently beneficial, and that the board acted arbitrarily and capriciously when it denied the application. Conte granted the company the variance and sent the application back to the zoning board for site plan approval.
