\"It seems to me that it is...demeaning to the best native traditions,\" said Justice Douglas Rutherford. \"There's nothing noble in it,\" he said after Dwayne David, 38, was found guilty by a jury of 25 counts. He argued they didn't apply to him as a Mohawk and he cited treaties made in previous centuries. David said he could not \"subject himself to foreign legal process\" since it would be contrary to the laws he follows as a traditional Mohawk. Prosecutor Diane Lahaie asked for a three to four year sentence for David with a credit for the 15 months he served in pre-trial custody. She also asked for the minimum fine of $60,000 on the cigarettes that were sold.
