The ACCC said an email sent by Allphones operations director Tony Baker on October 20 last year was \"threatening\" to franchisees, an allegation denied by Allphones. In the email, Mr Baker said \"several `market shocks' had affected suppliers' willingness to extend credit\" and that ongoing disputes with franchisees, for which Allphones may be liable, was \"a matter of concern to Allphones' suppliers and financiers as well as to Allphones and its directors\". Justice Foster also said \"although the evidence does not really support the ACCC's contention that Allphones has in fact already rationed stock on an inappropriate basis, I think the evidence does amount to proof of a prima facie case that Allphones has threatened to allocate stock upon a basis and in circumstances which are not truly for legitimate commercial reasons but are rather for the ulterior purpose of forcing its franchisees into the new arrangements.
