[Thomas McCluskey-Sharp] told police he only got involved in the huge brawl when he saw [Dylan Closter] outnumbered and on the ground, but the court heard Closter was the aggressor and there was no evidence to support McCluskey-Sharp's claim. McCluskey-Sharp's lawyer Dermot Dann said his client had worked hard to rebuild his life since [David Cassai]'s death, including establishing a concreting business and volunteering with the Salvation Army. At the time he got involved in the brawl that lead to Cassai's death, McCluskey-Sharp was already convicted of recklessly causing injury, intentionally causing injury, unlawful assault and assault with a weapon, as well as a drug-trafficking charge.
