هذا البحث في أحكام الزواج وفق أحكام الفقه الإسلامي، ولما كان موضوعها يمس الحياة ، الإجتماعية، في أنبل مقاصدها، وأسمى أغراضها، ولا يخفى ما لها من أثر على المجتمع جماة وافرادا عن التعقيد والتقعير، فكان لابد من أمرين : الأمر الأول : بيان أحكام الزواج في سهولة ويسر، بعيدا وملغز العبارات، وغريب الكلمات، ومعجم الألفاظ. والأمر الثاني : عدم الاقتصار على المذهب الحنفي، الذي كان عمل المحاكم جاريا عليه، ومازال فيما لم يرد بشأنه نص في القوانين المطبقة، وإنما آثرت أن نبين آراء فقهاء المذاهب الإسلامية الأخرى، لا سيما مذاهب الأئمة مالك والشافعي وأحمد بن على كثير من المسائل، مع بيان ما يستندون إليه من الأدلة، ثم النظر فيها والترجيح من بينها، اعتمادا الأقوى دليلا وأكثر مراعاة لمصالح الناس.
