يعني مبدأ المشروعية خضوع الحكام والمحكومين للقانون ويعد الالتزام بهذا المبدأ من السمات التي تتميز بها الدولة القانونية الحديثة والتي تخضع فيها الدولة بمختلف مؤسساتها وفي كل نشاطاتها وتصرفاتها للقواعد القانونية المكتوبة وغير المكتوبة فجميع الأعمال والتصرفات التي تقوم بها سلطات الدولة ومن بينها السلطة الإدارية يجب أن تنسجم مع مبدأ المشروعية مما يقتضي ويستوجب بالضرورة وجود نظام قضائي فعال يضمن رقابة حقيقية على أعمال الإدارة وتصرفاتها ويمنعها من التعسف في استخدام السلطة والخروج على الحدود المرسومة لها في القانون.
