تناولت زهية جويرو الأضواء في كتابها \"الأفتاء بين سياج المذهب وإكراهات التاريخ\" هذا الإفتاء في علاقته بالمذهب الفقهي عموما والمالكي خصوصا وهو المشغل الذي يوضح مسار المأسسة في تاريخ الفكر الإسلامي ومنهج ابن رشد الجد في إفتائه وكيفية تعامله مع مصادره سواء كانت قضية أو مستدلة بالإجماع في عدد من الحالات وبالقياس في حالات أخرى وطبيعة العلاقة الإشكالية بين المجتمع والدين والثقافة بالأندلس في آخر القرن الخامس الهجري وبداية السادس أي في آخر عهد ملوك الطوائف ومستهل الحضور المرابطي فيها.
