Indigeneity, Capitalism, and the Management of Dispossession
Focusing mainly on Asia, this article tracks a link between the collective, inalienable land‐tenure regimes currently associated with indigeneity and attempts to prevent piecemeal dispossession of small‐scale farmers through land sale and debt. Collective landholding is sometimes imposed by local groups on their own members as they act to defend their livelihoods and communities. More often, however, it has been imposed from outside, first by paternalistic officials of the colonial period and now by a new set of experts and advocates who assume responsibility for deciding who should and who should not be exposed to the risks and opportunities of market engagement. From the perspective of their proponents, however, attempts to institutionalize collective landholdings are not impositions at all. They simply confirm a culturally distinct formation naturally present among “tribal” or “indigenous” people. Yet rural populations have repeatedly failed to conform to the assumptions embedded in schemes designed for their protection. They cross social and spatial boundaries. Some demand recognition of individualized land rights as they respond to market opportunities. Others are unable to escape the extractive relations that visions of cultural alterity and harmonious collectivity too often overlook. Meanwhile, dispossessory processes roll on unrecognized or unobserved.
Archaeologies of Persistence: Reconsidering the Legacies of Colonialism in Native North America
This article seeks to define common ground from which to build a more integrated approach to the persistence of indigenous societies in North America. Three concepts are discussed—identity, practice, and context—that may prove useful for the development of archaeologies of persistence by allowing us to counter terminal narratives and essentialist concepts of cultural identity that are deeply ingrained in scholarly and popular thinking about Native American societies. The use of these concepts is illustrated in an example that shows how current archaeological research is challenging long-held scholarty and popular beliefs about the effects of colonialism in coastal California, where the policies of Spanish colonial missionaries have long been thought to have driven local native peoples to cultural extinction. By exploring how the sometimes dramatic changes of the colonial period were internally structured and are just one part of long and dynamic native histories, archaeologies of persistence may help to bring about a shift in how the archaeology of colonialism presents the histories of native peoples in North America—one that can make archaeology more relevant to descendant communities.
WHAT WAS THE INDIGÉNAT? THE ‘EMPIRE OF LAW’ IN FRENCH WEST AFRICA
What was the indigénat? This article approaches this question via three arguments. First, a study of the indigénat (the regime of administrative sanctions applied to colonial subjects) challenges the idea that French West Africa formed part of an ‘empire of law’. Second, a dynamic spectrum of political statuses developed around the indigénat until its abolition in 1946. This spectrum is no less significant than one of its poles alone, that of colonial citizens. Third, the indigénat, its narrative of reform, and its relationship to law, bureaucracy, and authority illuminate the tensions between imperial rhetoric and colonial governance.
POSSIBILITY AND CONSTRAINT: AFRICAN INDEPENDENCE IN HISTORICAL PERSPECTIVE
On the fiftieth anniversary of an ambiguous event – the referendum giving French Africans the choice of immediate independence or a new status within a ‘French Community’ – this article points to the alternative forms of political action which opened up at certain moments in African history and how, at other moments, some of those alternatives closed down. It assesses concepts, issues and arguments used in writing the history of Africa, now that the recent African past – spanning the last years of colonial rule and the years of independence – is becoming a focus of historical inquiry.
Mapping a Colonial Borderland: Objectifying the Geo-Body of India's Northeast
India's Northeast frontier is at the margins of three study areas: South Asia, Southeast Asia, and East Asia. This paper attempts a history of “mapping” in its broader sense as a cultural universal over a relatively long period. It is not a history of cartography, but focuses on the interface between cartography and cosmography, which were, in turn, shaped by imperial power and geographical knowledge. This approach offers a high-altitude view of this Asian borderland as the imperial frontier of both the Mughals and the British, and the national fringe of Republican India. The authors argue that imperial geographical discourses invested the colonial Northeast (British Assam) with a new kind of territorial identity. Surveyors and mapmakers objectified the “geo-body” of this borderland in a spatial fix and visualized it as a Northeast-on-the-map. Cartographic territoriality naturalized traditional frontiers into colonial borderlands, which, in turn, forged national boundaries.
NEO-TRADITIONALISM AND THE LIMITS OF INVENTION IN BRITISH COLONIAL AFRICA
Exploring a range of studies regarding the ‘invention of tradition’, the ‘making of customary law’ and the ‘creation of tribalism’ since the 1980s, this survey article argues that the case for colonial invention has often overstated colonial power and ability to manipulate African institutions to establish hegemony. Rather, tradition was a complex discourse in which people continually reinterpreted the lessons of the past in the context of the present. Colonial power was limited by chiefs' obligation to ensure community well-being to maintain the legitimacy on which colonial authorities depended. And ethnicity reflected longstanding local political, cultural and historical conditions in the changing contexts of colonial rule. None of these institutions were easily fabricated or manipulated, and colonial dependence on them often limited colonial power as much as facilitating it.
Legal Pluralism in Muslim-Majority Colonies: Mapping the Terrain
Abstract This essay aims to provide some analytical foundations for the study of legal pluralism in Muslim-majority colonies. Specifically, we contend that the incorporation of Islamic law into the colonial legal systems should be distinguished from the process of integration and codification of oral customs. As Islamic law constitutes a well-established legal system, based on written traditions and on elaborate institutions of learning and adjudication, its incorporation into the colonial legal system carried with it a number of implications. These are discussed, as are the tripartite relations that often emerge in Muslim-majority colonies between statutory laws, Islamic, and customary laws (ʿādat, ʿurf). The final section of the essay aims to present the articles included in this special issue and to place them within this broad context. Le présent article vise à établir des fondements théoriques à l'étude du pluralisme juridique dans les colonies à majorité musulmane. Il insiste en particulier sur la nécessité qu'il y a à distinguer l'incorporation de la loi islamique aux systèmes juridiques coloniaux, du processus d'intégration et de codification du droit coutumier non écrit. La loi islamique constitue un système bien établi, fondé sur des traditions écrites et pourvu d'institutions de formation et d'exercice complexes. Son incorporation au sein du système juridique colonial a entraîné un certain nombre de conséquences spécifiques, qui sont analysées ici. Une attention particulière est en outre accordée aux relations triangulaires qui se font jour entre loi statutaire, loi islamique et droit coutumier (ʿādat, ʿurf) dans les colonies à majorité musulmane. Enfin, la dernière partie est consacrée à la présentation des articles réunis dans le numéro spécial dédié à ces enjeux.
Intimate Desires: Dalit Women and Religious Conversions in Colonial India
Religious conversions by Dalits in colonial India have largely been examined as mass movements to Christianity, with an implicit focus on men. However, why did Dalit women convert? Were they just guided by their men, family, and community? This paper explores the interrelationship between caste and gender in Dalit conversions afresh through the use of popular print culture, vernacular missionary literature, writings of Hindu publicists and caste ideologues, cartoons, and police reports from colonial north India. It particularly looks at the two sites of clothing and romance to mark representations of mass and individual conversions to Christianity and Islam. Through them, it reads conversions by Dalit women as acts that embodied a language of intimate rights, and were accounts of resistant materialities. These simultaneously produced deep anxieties and everyday violence among ideologues of the Arya Samaj and other such groups, where there was both an erasure and a representational heightening of Dalit female desire. However, they also provide one with avenues to recover in part Dalit women's aspirations in this period.
Polyvalent Metaphors in South-Central California Missionary Processes
The Spanish missionary entrada (A.D. 1769 to 1833) along the California coast created a series of complex encounters between multiple cultural discourses. The Franciscan mission system directly brought colonial and indigenous cultural metaphorical understandings into play. Missionary and indigenous discourse interacted largely via the media of material culture, animals, embellished architecture, and landscape—media interpreted through preexisting cultural metaphors and understandings. Investigating how metaphors played a role in constituting colonial entanglements is important in understanding cultural interactions and change. Metaphors structured colonial interactions, simultaneously hindering and enabling missionary–indigenous relationships. These relationships created parameters for unforeseen transitory configurations: a process best theorized under the term polyvalence. By adopting polyvalence, the processes of colonialism can be approached without usage of ethnic or racialized terms such as creolization, hybridity, or amalgamation. In the case of indigenous south-central California, it is suggested here that widely different forms of evidence can be better appreciated without recourse to terms laden with racial or ethnic connotations. The evidence suggests that while missions may have failed to create entirely new ethnic groups, missionary endeavors did result in unanticipated outcomes, presenting problems and creative opportunities for indigenous groups living within immediate coastal and extended interior populations.
