County judge cites flaw in state law while imposing sentence in sexual assault case

Lancaster County Court Judge Paul K. Allison sentenced Christopher John Koch, 34, of 260 Yorktown Court, Malvern, to 6 to 23 months in prison and five years' probation on May 12 for having sexual contact with the victim. Koch also was ordered to pay restitution capped at $3,000. Koch and the victim were in a hot tub when Koch took of his pants and the victim took off her shirt and shorts according to a criminal complaint filed by Trooper Thomas E. Tran. Koch's defense attorney, Merrill Spahn, told Allison he never asks for a specific sentence, but in Koch's case, he felt it was necessary because of the unique facts of the case and because of flaws in the guideline.

Pleas entered in sex assault cases from incidents in Lancaster, Salisbury

A Lancaster man pleaded guilty recently to sexually assaulting a mentally disabled woman for more than a year. Juan Jesus Vargas, 40, of 125 Juniata St., pleaded guilty Feb. 6 to two counts each of rape, involuntary deviate sexual intercourse, aggravated indecent assault and indecent assault. Assistant District Attorney Jeff Conrad withdrew two counts of rape in exchange for the guilty plea, he said, because he was unable to prove the elements needed for a conviction on those charges. Judge Paul K. Allison ordered the probation and parole department to perform a background investigation on Vargas before he is sentenced. According to a criminal complaint filed by Lancaster city police Detective Sonja Stebbins, Vargas assaulted the 21-year-old Harrisburg woman \"on several occassions\" when she was in Lancater visiting relatives. The assaults occurred between May 2004 and April 2005, Stebbins writes in her report.

Judge Paul K. Allison ordered a background investigation be completed before sentencing Vargas.
