The Collapse of the Kyoto Protocol and the Struggle to Slow Global Warming

Even as the evidence of global warming mounts, the international response to this serious threat is coming unraveled. The United States has formally withdrawn from the 1997 Kyoto Protocol; other key nations are facing difficulty in meeting their Kyoto commitments; and developing countries face no limit on their emissions of the gases that cause global warming. In this clear and cogent book-reissued in paperback with an afterword that comments on recent events--David Victor explains why the Kyoto Protocol was never likely to become an effective legal instrument. He explores how its collapse offers opportunities to establish a more realistic alternative.
Global warming continues to dominate environmental news as legislatures worldwide grapple with the process of ratification of the December 1997 Kyoto Protocol. The collapse of the November 2000 conference at the Hague showed clearly how difficult it will be to bring the Kyoto treaty into force. Yet most politicians, policymakers, and analysts hailed it as a vital first step in slowing greenhouse warming. David Victor was not among them.
Kyoto's fatal flaw, Victor argues, is that it can work only if emissions trading works. The Protocol requires industrialized nations to reduce their emissions of greenhouse gases to specific targets. Crucially, the Protocol also provides for so-called \"emissions trading,\" whereby nations could offset the need for rapid cuts in their own emissions by buying emissions credits from other countries. But starting this trading system would require creating emission permits worth two trillion dollars--the largest single invention of assets by voluntary international treaty in world history. Even if it were politically possible to distribute such astronomical sums, the Protocol does not provide for adequate monitoring and enforcement of these new property rights. Nor does it offer an achievable plan for allocating new permits, which would be essential if the system were expanded to include developing countries.
The collapse of the Kyoto Protocol--which Victor views as inevitable--will provide the political space to rethink strategy. Better alternatives would focus on policies that control emissions, such as emission taxes. Though economically sensible, however, a pure tax approach is impossible to monitor in practice. Thus, the author proposes a hybrid in which governments set targets for both emission quantities and tax levels. This offers the important advantages of both emission trading and taxes without the debilitating drawbacks of each.
Individuals at all levels of environmental science, economics, public policy, and politics-from students to professionals--and anyone else hoping to participate in the debate over how to slow global warming will want to read this book.
Greenhouse gas emissions and the role of the Kyoto Protocol

Our study empirically investigates the effects of the Kyoto Protocol’s quantified emission limitation or reduction commitments on various greenhouse gas (GHG) emissions such as carbon dioxide (CO
2
), methane (CH
4
), nitrous oxide (N
2
O), and other greenhouse gases consisting of hydrofluorocarbons (HFCs), perfluorocarbons (PFCs), and sulfur hexafluoride (SF
6
). These GHG emissions are considered to be the main source of global warming issues, and 39 countries approved to meet the commitments by ratifying the Kyoto Protocol. Our empirical analysis is based on the Stochastic Impacts by Regression on Population, Affluence, and Technology (STIRPAT) model, the stochastic version of the IPAT model, using the data of 119 countries from 1990 to 2005. Our main findings are that the effects of the commitments to the Kyoto Protocol are (1) significantly negative for the cases of CO
2
and CH
4
emissions, (2) not significant for the case of N
2
O emissions, and (3) significantly positive for the case of other greenhouse gas emissions. These results have important policy implications for global warming issues.

The Roles of Four Important Contexts in Japan’s Carbon Neutrality Policy and Politics, 1990–2020

This study answers four research questions by contextualising the background to Japan’s “carbon neutrality and net-zero” (CNN) policy, which was announced in October 2020, and identifying important changes in Japanese climate policy between 1990 and 2020. What is the link between the problem of fairness under the Kyoto targets and the Japanese government’s initial reluctance towards ambitious carbon emission reductions? Why did the Japanese business sector initially resist the possibility of ambitious carbon emission reductions? How has the term “climate crisis” contributed to the need for CNN policy? Why did the Japanese government change its reluctant stance and announce the CNN policy in October 2020? Four main findings were extracted from a narrative technique-based analysis of Japan’s policy documents related to CNN. The following are the findings: [i] the framing of climate change as a “climate crisis” by influential Japanese climate stakeholders was a key motivation for Japan to formally announce its CNN policy in October 2020; [ii] pressure from the international community and the political leadership of the Yoshihide Suga administration are essential factors that led the Japanese government to change its stance and announced this policy; [iii] it is possible that the policy could have been announced sooner, but concern among Japanese climate stakeholders about the problem of fairness in the Kyoto Protocol’s emission reduction targets likely impeded such an announcement; and [iv] this concern underpinned Keidanren’s (or the business sector’s) consistent opposition to the introduction of regulatory schemes. These results emerge for the first time in a study of Japan’s carbon neutrality, particularly in terms of the broader context of climate politics. Finally, we offer a possible explanation for Suga’s deliberate announcement of the CNN policy. This opens up space for future research to complement our study by providing important indicators on the trajectory of this important policy.

This article argues that the UN Framework Convention on Climate Change (UNFCCC)’s conception of common but differentiated responsibilities and respective capabilities (CBDRRC) was never effectively implemented through the Kyoto Protocol. The investments under the Kyoto Protocol’s Clean Development Mechanism suggest that CBDRRC has been used by developed countries to buy a “right to pollute”, i.e., maintaining or even increasing their greenhouse gas emissions, while investing in clean energy in developing nations, thus defeating the essence of CBDRRC as intended under the UNFCCC.
Second, it points out that the Paris Agreement reflects a significant shift in the overall concept of CBDRRC, both in terms of its textual understanding as well as its implementation. A qualifier, “in the light of national circumstances”, was added to the principle of CBDRRC in the Paris Agreement, allowing a form of voluntary self-differentiation. This qualifier diluted a top-down, objective analysis of States’ commitments. For several scholars, this shift has meant a softening of the principle, making the “differentiation” more dynamic and flexible.
In the authors’ opinion, the qualifier is a fundamental modification of the principle to make it politically more palatable. It completely disregards the notion of historical responsibility for climate change, which was the cornerstone of CBDRRC as conceived under the UNFCCC. Therefore, rather than presenting a more flexible understanding of UNFCCC’s conception of CBDRRC, the Paris Agreement marks a total departure from it. Lacking an explicit redefinition of the principle of CBDRRC, it is misleading to contend that the Paris Agreement is still anchored in it.

The Economics and Politics of Climate Change

The international framework for a climate change agreement is up for review as the initial Kyoto Protocol period to 2012 comes to an end. Though there has been much enthusiasm from political and environmental groups, the underlying economics and politics remain highly controversial. This book takes a cool-headed look at the critical roadblocks to agreement, examining the economics of climate change, the incentives of the main players (the United States, EU, China), and the policies which governments can put in place to reduce greenhouse gas emissions, and ultimately shift our economies onto a low-carbon path. It questions the basis of much of the climate change consensus and debates the Stern Review's main findings. Aside from a reassessment of the economics of climate change, the book looks at the geography of the costs and benefits of climate change — the very different perspectives of Africa, China, Europe, and the United States — as well as the prospects for a new global agreement. It also considers policy instruments at the global level (whereas much of the literature to date is nationally and regionally based). Trading and R&D, along with more radical unilateral options, including geoengineering, are discussed. Finally, the book describes the institutional architecture — drawing on evidence from previous attempts in other areas, as well as proposals for new bodies.
The European Union Emissions Trading System reduced CO₂ emissions despite low prices

International carbon markets are an appealing and increasingly popular tool to regulate carbon emissions. By putting a price on carbon, carbon markets reshape incentives faced by firms and reduce the value of emissions. How effective are carbon markets? Observers have tended to infer their effectiveness from market prices. The general belief is that a carbon market needs a high price in order to reduce emissions. As a result, many observers remain skeptical of initiatives such as the European Union Emissions Trading System (EU ETS), whose price remained low (compared to the social cost of carbon). In this paper, we assess whether the EU ETS reduced CO₂ emissions despite low prices. We motivate our study by documenting that a carbon market can be effective if it is a credible institution that can plausibly become more stringent in the future. In such a case, firms might cut emissions even though market prices are low. In fact, low prices can be a signal that the demand for carbon permits weakens. Thus, low prices are compatible with successful carbon markets. To assess whether the EU ETS reduced carbon emissions even as permits were cheap, we estimate counterfactual carbon emissions using an original sectoral emissions dataset. We find that the EU ETS saved about 1.2 billion tons of CO₂ between 2008 and 2016 (3.8%) relative to a world without carbon markets, or almost half of what EU governments promised to reduce under their Kyoto Protocol commitments. Emission reductions in sectors covered under the EU ETS were higher.

THE U.S INACTION ON CLIMATE CHANGE: REALISM AND ITS INTERPRETATIONS

President Donal Trump announced the U.S. withdrawal from the 2015 Paris Agreement, and stated that the withdrawal was mainly to protect its national interests. The U.S. economic ambitions, the China factor and the intricacies of U.S domestic politics had played a major role in deciding the U.S. position on the Paris Agreement and the Kyoto Protocol of 1997. There are some who are sceptical on whether the Paris Agreement would successfully achieve its expected outcomes in the absence of U.S. participation. The objective of this study is to examine the factors that have discouraged the U.S. to partake in the international climate change agreements. An analytical framework was employed for this study that examines the insights and conceptions from the textual data, based on realism. The study concludes that the U.S. outlook on climate change had more or less adhered to the realist stance, even though realism is considered a theoretical approach with significant drawbacks, particularly when dealing with issues of climate change. Nonetheless, this study also asserts that there is a need for deeper engagement between the U.S. and the participants of the Paris Agreement to effectively tackle the issues of climate change at this moment.

Measuring the effect of Kyoto protocol agreement on countries' environmental efficiency in CO₂ emissions: an application of conditional full frontiers

This paper applies the probabilistic approach developed by Daraio and Simar (J Prod Anal 24:93-121, 2005, Advanced robust and nonparametric methods in efficiency analysis. Springer Science, New York, 2007a, J Prod Anal 28: 13-32, 2007b) in order to develop conditional and unconditional data envelopment analysis (DEA) models for the measurement of countries' environmental efficiency levels for a sample of 110 countries in 2007. In order to capture the effect of countries compliance with the Kyoto protocol agreement (KPA) policies, we condition first the years since a country has signed the KPA until 2007 and secondly the obliged percentage level of countries' emission reductions. Particularly, various DEA models have been applied alongside with bootstrap techniques in order to determine the effect of KPA on countries' environmental efficiencies. The study illustrates how the recent developments in efficiency analysis and statistical inference can be applied when evaluating environmental performance issues. The results indicate a nonlinear relationship between countries' obliged percentage levels of emission reductions and their environmental efficiency levels. Finally, a similar nonlinear relationship is also recorded between the duration which a country has signed the KPA and its environmental efficiency levels.

The Desirability of Depoliticization: Compliance in the International Climate Regime

The Kyoto Protocol is remarkable among global multilateral environmental agreements for its efforts to depoliticize compliance. However, attempts to create autonomous, arm’s length and rule-based compliance processes with extensive reliance on putatively neutral experts were only partially realized in practice in the first commitment period from 2008 to 2012. In particular, the procedurally constrained facilitative powers vested in the Facilitative Branch were circumvented, and expert review teams (ERTs) assumed pivotal roles in compliance facilitation. The ad hoc diplomatic and facilitative practices engaged in by these small teams of technical experts raise questions about the reliability and consistency of the compliance process. For the future operation of the Kyoto compliance system, it is suggested that ERTs should be confined to more technical and procedural roles, in line with their expertise. There would then be greater scope for the Facilitative Branch to assume a more comprehensive facilitative role, safeguarded by due process guarantees, in accordance with its mandate. However, if – as appears likely – the future compliance trajectories under the United Nations Framework Convention on Climate Change will include a significant role for ERTs without oversight by the Compliance Committee, it is important to develop appropriate procedural safeguards that reflect and shape the various technical and political roles these teams currently play.

The Emissions Database for Global Atmospheric Research (EDGAR) compiles anthropogenic emissions data for greenhouse gases (GHGs), and for multiple air pollutants, based on international statistics and emission factors. EDGAR data provide quantitative support for atmospheric modelling and for mitigation scenario and impact assessment analyses as well as for policy evaluation. The new version (v4.3.2) of the EDGAR emission inventory provides global estimates, broken down to IPCC-relevant source-sector levels, from 1970 (the year of the European Union's first Air Quality Directive) to 2012 (the end year of the first commitment period of the Kyoto Protocol, KP). Strengths of EDGAR v4.3.2 include global geo-coverage (226 countries), continuity in time, and comprehensiveness in activities. Emissions of multiple chemical compounds, GHGs as well as air pollutants, from relevant sources (fossil fuel activities but also, for example, fermentation processes in agricultural activities) are compiled following a bottom-up (BU), transparent and IPCC-compliant methodology. This paper describes EDGAR v4.3.2 developments with respect to three major long-lived GHGs (CO2, CH4, and N2O) derived from a wide range of human activities apart from the land-use, land-use change and forestry (LULUCF) sector and apart from savannah burning; a companion paper quantifies and discusses emissions of air pollutants. Detailed information is included for each of the IPCC-relevant source sectors, leading to global totals for 2010 (in the middle of the first KP commitment period) (with a 95 % confidence interval in parentheses): 33.6(±5.9) Pg CO2 yr−1, 0.34(±0.16) Pg CH4 yr−1, and 7.2(±3.7) Tg N2O yr−1. We provide uncertainty factors in emissions data for the different GHGs and for three different groups of countries: OECD countries of 1990, countries with economies in transition in 1990, and the remaining countries in development (the UNFCCC non-Annex I parties). We document trends for the major emitting countries together with the European Union in more detail, demonstrating that effects of fuel markets and financial instability have had greater impacts on GHG trends than effects of income or population.
