Namen: Vključevanje umetne inteligence v avtomatizirano odločanje je prelomen trenutek za javno upravo. Prispevek obravnava uvedbo sistemov avtomatiziranega odločanja v upravne postopke, zlasti njihov vpliv na varstvo osebnih podatkov in temeljna načela upravnega prava.Zasnova/metodologija/pristop: Študija s pomočjo deskriptivne, normativne in dogmatske metode proučuje nedavne zakonodajne pobude in analizira izbrane primere uporabe avtomatiziranega odločanja v Sloveniji in tujini. Ob tem podrobneje analizira odločitev Sodišča EU iz leta 2023 v zadevi Schufa. S kombinacijo teoretičnih vidikov in praktičnih spoznanj študija ponuja primerjalno analizo evropskega in slovenskega zakonodajnega okvira.Ugotovitve: Prispevek presoja vpliv avtomatiziranega odločanja na ključna načela upravnega prava in varstva podatkov ter osvetljuje zakonodajne, organizacijske in tehnološke spremembe, potrebne za zagotovitev skladnosti avtomatiziranega določanja z obstoječo zakonodajo.Akademski doprinos k znanosti: Prispevek ponuja dragocene smernice za upravnopravno stroko in tako izboljšuje razumevanje uvajanja tehnologij avtomatiziranega odločanja v upravno prakso. Njegove ugotovitve so oblikovalcem politik in zakonodajalcem lahko v pomoč pri oblikovanju predpisov, ki vključujejo prednosti umetne inteligence, hkrati pa zagotavljajo, da so ti sistemi ustrezno nadzorovani.Raziskovalne/praktične/družbene posledice: Uvedba avtomatiziranega odločanja mora biti usklajena s pravnimi načeli, da se ohranijo preglednost, odgovornost in varstvo temeljnih pravic. Prispevek poudarja, da je pomembno ne le razumeti pravne posledice, temveč tudi zagotoviti, da tehnologije avtomatiziranega odločanja spoštujejo standarde dobrega upravljanja.Izvirnost/vrednost: Študija premika meje uveljavljenih pravnih okvirov in odpira kritična vprašanja o tem, kako temeljna načela upravnega prava in varstva podatkov prilagoditi novim tehnologijam. Umetno inteligenco vsekakor velja izkoristiti za povečanje učinkovitosti, hkrati pa je treba zagotoviti, da inovacije spoštujejo pravice posameznikov, varujejo javni interes ter podpirajo standarde dobre uprave in dobrega upravljanja. Purpose: The integration of artificial intelligence (AI) in automated decision-making (ADM) represents a transformative moment in public administration. This paper explores the incorporation of ADM systems into administrative procedures, focusing on their impact on personal data protection and the fundamental principles underpinning administrative law.Design/Methodology/Approach: Utilising a combination of descriptive, normative, and doctrinal research methods, the study draws on recent regulatory initiatives, analyses selected ADM use cases in Slovenia and abroad, and closely examines the 2023 Schufa case decided by the Court of Justice of the European Union (CJEU). By combining theoretical perspectives with practical insights, the research provides a comparative analysis within the context of EU and Slovenian legal frameworks.Findings: The study assesses how ADM systems interact with, and potentially reshape, key principles of administrative and data protection law. It presents a clear picture of the legislative, organisational, and technological changes required to ensure that ADM systems align with existing legal frameworks.Academic Contribution to the Field: By offering valuable guidance for public administration professionals, the paper enhances the understanding of implementing ADM technologies in administrative practice. Its insights assist policymakers and legislators in crafting regulations that embrace the benefits of AI while ensuring these systems are subject to proper oversight.Research/Practical/Social Implications: The deployment of ADM systems must align with legal principles to maintain transparency, accountability, and the protection of fundamental rights. This paper highlights the importance of not only understanding the legal implications but also ensuring that ADM technologies uphold standards of good governance.Originality/Value: This research extends the boundaries of established legal frameworks and raises critical questions about how core principles of administrative and data protection law can adapt to new technologies. The challenge lies in leveraging AI to increase efficiency while ensuring these innovations respect individual rights, safeguard the public interest, and uphold standards of good administration and governance.

The Nature and Existence of Jurisprudence in State Administrative Courts in Indonesia

Objective: This study aims to examine the effectiveness of jurisprudence in resolving cases by judges to achieve legal certainty, justice, and utility in their decisions. Theoretical Framework: Drawing on legal principles and legislative frameworks such as Article 28 of Law No. 48/2009 on Judicial Power, Article 22 AB (Algemene Bepalingen Van Wetgeving), and Article 1917 of the Burgerlijk Wetboek (BW), this research explores the role of jurisprudence as a source of law and its significance in the judicial process. Methodology: This research employs a qualitative approach, utilizing legal analysis and case studies to investigate the application of jurisprudence by judges in resolving cases. Data collection involves examining legal documents, court decisions, and scholarly literature related to the topic. Results and Conlusion: The findings indicate that jurisprudence plays a crucial role in enhancing legal certainty, justice, and utility in judicial decisions. Judges utilize jurisprudential principles as guiding frameworks to ensure consistency and fairness in their rulings, thus contributing to the effectiveness of the legal system. this study highlights the importance of jurisprudence in achieving the objectives of the judicial system. By incorporating jurisprudential principles into their decision-making processes, judges can uphold legal certainty, promote justice, and maximize the utility of their rulings, ultimately strengthening the rule of law. Objetivo: Este estudo tem como objetivo examinar a eficácia da jurisprudência na resolução de casos pelos juízes para obter segurança jurídica, justiça e utilidade em suas decisões. Estrutura teórica: Com base em princípios jurídicos e estruturas legislativas, como o artigo 28 da Lei nº 48/2009 sobre o Poder Judiciário, o artigo 22 AB (Algemene Bepalingen Van Wetgeving) e o artigo 1917 do Burgerlijk Wetboek (BW), esta pesquisa explora o papel da jurisprudência como fonte de direito e sua importância no processo judicial. Metodologia: Esta pesquisa emprega uma abordagem qualitativa, utilizando análise jurídica e estudos de caso para investigar a aplicação da jurisprudência pelos juízes na resolução de casos. A coleta de dados envolve o exame de documentos jurídicos, decisões judiciais e literatura acadêmica relacionada ao tópico. Resultados e conclusões: Os resultados indicam que a jurisprudência desempenha um papel fundamental no aumento da segurança jurídica, da justiça e da utilidade das decisões judiciais. Os juízes utilizam princípios jurisprudenciais como estruturas de orientação para garantir a consistência e a justiça em suas decisões, contribuindo, assim, para a eficácia do sistema jurídico. este estudo destaca a importância da jurisprudência para atingir os objetivos do sistema jurídico. Ao incorporar os princípios jurisprudenciais em seus processos de tomada de decisão, os juízes podem defender a segurança jurídica, promover a justiça e maximizar a eficácia do sistema jurídico.

Protection of Customers from Unlawful Acts by Banks through Synergy of Legal Principles

Efforts to protect consumers from unlawful acts are realized through the liability of business actors for losses suffered by consumers, as in Article 1365 of the Civil Code. However, liability for illegal actions on the part of the bank often places the customer as a weak party compared to the bank, so effective consumer protection efforts are not guaranteed. One of the reasons is the need for banks' understanding of consumer protection law principles due to the need for in-depth studies on the synergy of principles of consumer protection law associated with the principle of fault and responsibility of the bank. This research uses the normative method that refers to legislation and principles as a basis for applying the law, accompanied by conceptual analysis by examining existing theoretical concepts on one problem. The results show that the synergy of legal principles is realized with principles of economic law development and consumer protection so that bank negligence and standard agreements that only benefit the bank and harm customers can be avoided, such as principles of good faith, prudence, accountability of business actors, and happiness. The interpretation of legal principles is expected to suit the bank to uphold values and justice in the context of good customer protection.

This paper investigates the basis arguments of so-called legal logic and their relation to logic in its standard meaning. There is no doubt that legal arguments belong to logic in the wide sense (
), but their reduction to schemes of formal logic (
) is a controversial issue. It can be demonstrated that only some legal arguments fall under explicit rules of formal logic, that is, having a deductive character. Most such reasoning is fallible, and its correctness depends on appealing to extra-logical principles taken from legal norms. For instance, if we say, “If it is permitted more, then it is permitted less” (
), we assume that the concepts expressed by the words “more” and “less” are already defined.

Organizational and legal principles of information security of enterprises in the conditions of martial law in Ukraine

Purpose. To investigate the peculiarities of organizational and legal provision of information security (IS) in the conditions of martial law (ML). To propose changes to legislative provisions to improve legal regulation in this area. To develop systematic measures to balance the rights and obligations of individuals and legal entities in the field of IS in the conditions of ML. Methodology. The general scientific and special legal methods of cognition are used: hermeneutic method allowed us to substantiate expansion of IS field; content analysis – to determine organizational principles of IS of enterprises in conditions of ML; structural and legal – to propose indicator conditions for legal norms; special-legal – to propose system of local regulatory acts for the legal provision of IS; comparative legal – to propose special legal regime for IS of enterprises. Findings. It is indicated that during the state of war, the IS field of enterprise expands significantly and becomes an element of the national security system. The peculiarities of organizational and legal support and the basic organizational principles of IS of enterprises in the conditions of ML are determined. It is proposed to introduce a special legal regime for implementation of IS of enterprises in conditions of ML and use of the state’s capabilities in this area under specified legal regime. Amendments to the articles of Special Part of Code of Ukraine on administrative offenses are proposed for effective regulatory support of the special legal regime for implementation of IS of enterprises Originality. A legal tool is proposed to limit dissemination of information about a company’s activities – the introduction of local law documents to classify information about the company’s activities during ML into category “with limited access”. Indicator conditions and additions to legislative norms are proposed. Practical value. The developed proposals, indicator conditions and additions to legislative norms will contribute to strengthening the IS of enterprises.

Reevaluating the Principle of Legal Fiction: Balancing Legal Certainty and Social Justice

The principle of legal fiction is widely recognized for its role in legitimizing laws and ensuring legal certainty. However, while it contributes to the stability and predictability of legal applications, it also has inherent weaknesses that may lead to unjust outcomes, particularly for vulnerable groups who are unaware of the law. In the context of Indonesia’s vast territory, the lack of widespread socialization and public awareness of new legal regulations exacerbates these issues. Consequently, individuals, especially from lower socioeconomic classes, may become inadvertently entangled in legal processes due to their ignorance of applicable laws, leading to potential injustices. The principle of legal fiction, therefore, may inadvertently serve as a tool of oppression, particularly when used to position suspects as defendants without adequate awareness or understanding of their legal rights. This paper argues for a re-evaluation and improvement of the principle to ensure a more just and transparent application. A more nuanced approach is needed, distinguishing between its absolute application in criminal cases and its non-absolute use in regulatory offenses. By refining the concept of legal fiction, we can enhance both its legitimacy and its capacity to uphold justice for all members of society.

Structural Violence and Religious Freedom: Towards a Legal Principle of Structural Justice in the Chilean Experience

Recent Chilean jurisprudence on Indigenous religious freedom has revealed a profound dissonance between the legal categories applied by the courts and the spiritual conceptions of Indigenous peoples. This gap between formal recognition and the effective protection of sacred sites generates a form of structural violence, understood as the institutional reproduction of inequality under the guise of neutrality. This study proposes to reformulate the notion of structural violence as an operative legal principle capable of activating heightened judicial scrutiny. Through a qualitative approach, it develops a doctrinal and jurisprudential analysis aimed at identifying normative patterns of exclusion and assessing the hermeneutic, normative, and diagnostic functions of the proposed principle. The results show that Chilean law, by translating spiritual practices into liberal categories of property or procedure, neutralizes their religious content and perpetuates relations of subordination. The study concludes that incorporating the principle prohibiting structural violence enables the reinterpretation of legal norms and the correction of historical asymmetries, orienting the law toward a form of structural justice sensitive to the ontological, cultural, and spiritual plurality of Indigenous peoples.

Advances in neuroscience and other disciplines are producing large-scale brain data consisting of datasets from multiple organisms, disciplines, and jurisdictions in different formats. However, due to the lack of an international data governance framework brain data is currently being produced under various contextual ethical and legal principles which may influence key stakeholders involved in the generation, collection, processing and sharing of brain data thereby raising ethical and legal challenges. In addition, despite the demand for a brain data governance framework that accounts for culture, there is a gap in empirical research and actions to understand how key stakeholders around the world view these issues using neuroscientists who are affected by these ethical and legal principles. Therefore, using the research question how do ethical and legal principles influence data governance in neuroscience? we attempt to understand the perceptions of key actors on the principles, issues and concerns that can arise from brain data research. We carried out interviews with 21 leading international neuroscientists. The analytical insights revealed key ethical and legal principles, areas of convergence, visibility, and the contextual issues and concerns that arise in brain data research around these principles. These issues and concerns circulate around intimately connected areas which include ethics, human rights, regulations, policies and guidelines, and participatory governance. Also, key contextual insights around animal research and ethics were identified. The research identifies key principles, issues, and concerns that need to be addressed in advancing the development of a framework for global brain data governance. By presenting contextual insights from neuroscientists across regions, the study contributes to informing discussions and shaping policies aimed at promoting responsible and ethical practices in brain data research. The research answers the call for a cross cultural study of global brain data governance and the results of the study will assist in understanding the issues and concerns that arise in brain data governance.

The Search for Originality within Established Boundaries—Rereading Najm al-Dīn al-Ṭūfī (d. 716/1316) on Public Interest (maṣlaḥa) and the Purpose of the Law

With the arrival of the twentieth century, in their legal theory, Muslim scholars began emphasizing public interest (maṣlaḥa) and the objectives (maqāṣid) of the Sharia. This stood often in contrast to the standards of traditional legal theory. To overcome this gap, scholars searched for concepts of premodern scholars, interpreted them in a way that allowed focusing on abstract categories like maṣlaḥa. An often-quoted figure in this regard is Najm al-Dīn al-Ṭūfī (d. 716/1316). In his hadith commentary entitled al-Taʿyīn, al-Ṭūfī developed a legal framework in which he gave precedence to maṣlaḥa over the Quran, Sunna, and Consensus in cases where there are conflicts between these sources concerning the ruling for a given matter. Many contemporary scholars interpret al-Ṭūfī’s concept from a modern perspective. This approach either leads to overemphasizing al-Ṭūfī’s theory or rejecting it entirely. The present study will analyze al-Ṭūfī’s theory of maṣlaḥa within the established premodern epistemological and hermeneutical boundaries that al-Ṭūfī himself accepted. In doing so, it will locate al-Ṭūfī’s conception of maṣlaḥa in its historical context and in relation to al-Ṭūfī’s biography. The study will show that al-Ṭūfī’s theory, regardless of its modern reception, and with all its pitfalls, is an original attempt to find new ways for deriving norms within the boundaries of a well-established legal theory and in a specific historical context.
