Tri-City's bond attorney says measure stands without full facilities plan
Diane Potter, an Sacramento attorney with the international firm Orrick Herrington & Sutcliffe, specializes in school and health care bonds and was hired by Tri-City to review the hospital's repair and renovation bond measure that will appear on the June 6 primary ballot. The measure requires two-thirds voter approval to pass. Potter said she finds nothing in the law that indicates Tri-City must be able to provide one document, a Master Facilities Plan, just because it is mentioned in the bond measure's text. She said the law requires Tri-City to specify what it would spend potential bond revenue on, and added that she believes the public hospital has done exactly that. Additionally, Potter said it was important that Tri-City include information on a Citizens Oversight Committee that would be formed to approve all expenditures made by the hospital if the bond passes. Likewise, she said it was important in the bond measure to state clearly that bond money cannot be used to purchase equipment or pay for salaries.
