Overview
إن الطبيعة الخاصة للملكية الفكرية من حيث النظر في كونها ملكية أم لا وطبيعة الحقوق التي تتفرع عنها فيما إذا كانت حقوق عينية أو حقوق شخصية أو خليط من الإثنين، كل هذه الخصوصية التي ارتسمت حول الملكية الفكرية جعلت السؤال قائما فيما إذا كان بالإمكان النظر في النزاعات التي تثور حولها من قبل التحكيم، وخاصة الاقتصاد العالمي اليوم، وبالتالي من الضروري بمكان، ومن أجل إعطاءها بعض المرونة التي يتطلبها النظام الاقتصادي العالمي، التفكير في إدخال التحكيم كشريك في حل المنازعات التي تثور حول الملكية الفكرية، هذا الأمر يقتضي ضرورة النظر في علاقة الملكية الفكرية بالنظام العام.
