تعتبر الصفقات العمومية الأداة الإستراتيجية الوحيدة، والتي يمكن من خلالها تسيير الأموال العامة بشكل فعال وأمثل من أجل تنشيط العجلة الاقتصادية وتحديد الأهداف المسطرة، وهذا من خلال البرامج التنموية للدولة.ntلذا فهي تخضع بذلك إلى نظام قانوني متميزا يختلف عما هو مألوف في روابط القانون الخاص، في حين تتسم طرق إبرامها بصفة خاصة ولإجراءات في غاية من التعقيد، حيث تأتي المناقصة كقاعدة أصلية في إبرام الصفقات العمومية، بينما أسلوب التراضي يراد به كإجراء استثنائي يستطاع اللجوء إليه من خلال حالات معينة ومحددة في القانون.
