Overview
إن سلطة السمعي البصري أكدت ضوابطها من خلال قانون 14-04 من الناحية الوظيفية والعضوية، بتحديد استقلاليتها وفعاليتها وحدود ذلك، واتضح أن المسألة نسبية من خلال تبعيتها للسلطة التنفيذية، وإن كان القانون العضوي رقم 12-05 الذي نظمها لأول مرة قد منح لها جانب من الحرية والاستقلالية لمزاولة مهامها من خلال تشكيلتها واختصاصاتها، وبالتالي فان نسبية الاستقلال لا يمنع ولا يكبح هذه السلطة من مزاولة نشاطها على جانب من الفعالية وفقا للنصوص التي تنظمها.
