Overview
تعد أحكام الكفالة من الأحكام الأكثر تعقيدا باعتبارها تخص فئة معينة من المجتمع، غير أن المشرع الجزائري نظم هذه الأحكام وفق نصوص قانونية من أجل دمج هذه الفئة في وسط أسري طبقا لشروط قانونية معينة يتوجب توافرها في العائلة الكافلة. كما ترتب الكفالة آثارا قانونية تنتج من خلالها التزامات إزاء الطرف الكافل وحقوق بالنسبة للطرف المكفول. وسنتعرف من خلال هذه الدراسة على شروط تطبيق أحكام الكفالة في التشريع الجزائري وآثارها القانونية بالنسبة لأطرافها، كما سنعرج على بعض الإشكالات القانونية التي تواجهها الكفالة في الجزائر.
