Overview
يفترض هذا البحث أن الادعاء العام يقوم بدر كبير بالغ في الأهمية في تحريك الدعوى الجزائية والتحري عن الجرائم وكذلك مرحلتي التحقيق والمحاكمة، وقد توصل البحث إلى أن المشرع العراقي استحدث وظيفة حديثة بعنوان معاون المدعي العام داخل جهاز الادعاء العام، ويختص بتمثيل الحق العام في كل دعوي تكون الدولة طرفا فيها، ويكون ذلك إلى جانب الممثل القانوني للدائرة صاحبة الحق بالدعوي. اقترح البحث على المشرع العراقي تعديل المادة (3/ أولا) واقتصار مكونات الادعاء العام على رئيس ونائب للرئيس وعدد من المدعين العامين ونواب المدعين العامين، دون شمول معاوني الادعاء العام.
