يعد التامين على القرض العقاري من بين اهم الضمانات التي تشترطها البنوك المانحة للقروض العقارية على المقترضين حتى يتم الموافقة على منحهم القروض المطلوبة لتمويل مشاريعهم السكنية، وترجع أهمية هذا النوع من التامين إلى الحماية التي يوفرها فهو يعتبر آلية حمائية بامتياز لصالح البنوك من خطر عدم الوفاء وأداة تحفيزهم على منح قروض جديدة، وعليه حاولت في هذه الورقة البحثية أن ادرس هذه الضمانة على ضوء التشريع الجزائري
